By submitting this application for use of the Democratic Party of Outagamie County (“DPOC”) office space at 516 W College Ave, Appleton, WI (the “Office”), you (the “Renter”) are agreeing to the following terms and conditions:
The Office is a non-smoking environment. Catering is allowed and if alcohol is served, a licensed bartender or other certified and trained person must be provided. Underage drinking is not permitted, and is the responsibility of the Renter. All events must be over and clean up completed by the end of the reserved time.
A rental fee may be charged depending upon several factors, including the nature of the event for which the Renter will be using the Office. All such fees will be discussed and agreed upon between the DPOC and the Renter prior to the reservation being finalized. Depending on the size and nature of the event, members of the DPOC may present during the event for security, lock up, and assistance. Any rental fee charged is due to the DPOC prior to the scheduled event.
The conduct of all participants and spectators while at the Office shall be the responsibility of the Renter. The Renter also accepts all responsibility for any injury to person(s) or property, or loss of or damage to property or theft of personal property at the Office during the rental period, or resulting from the rental. The Office retains the right to evict objectionable persons from the premises or to call for security/police help if deemed necessary. Violations may result in denial of future reservation requests.
INDEMNIFICATION: The Renter shall release, indemnify, keep and save harmless the DPOC and its agents, officers, employees, or members from any and all responsibility or liability for any and all damages or injury of any kind or nature whatever (including death) to all persons, whether agents or employees of the Renter or persons attending the events for which the premises have been leased, and to all property damage proximately caused by, incident to, resulting from, arising out of, occurring in connection with, the use by the Renter of the premises. The provisions of this section shall include any and all losses, damages, injuries, settlements, judgments, decrees, awards, fines, penalties, claims, costs and expenses, including reasonable attorney‘s fees.
The Office must be left in the condition in which they were found at the beginning of the rental period. All trash must be removed from the building. The Renter must immediately take care of any spillage. If the Renter is unable to remove spillage, the DPOC reserves the right to have the area professionally cleaned at the Renter’s expense. Any damage to the Office or any property contained in the Office during the rental period will be the responsibility of the Renter. This includes, but is not limited to, damage to the walls, floors, fixtures, and property.
By completing the reservation request, the Renter acknowledges having read and understood these terms and acknowledges that these terms are binding on the Renter and any organization the Renter represents.
